These “Terms of Service” (hereinafter, “Terms”) set forth the rules for using the website rotation.pt (hereinafter, “website”) and the contractual relationships between its users/customers (hereinafter, “users” or “customers”) and the owner – Subtle Confidence LDA., company registration number 517101700, with its registered office at Monte Vinha do paneiro, 7800-650, Beja, Portugal, email address contact.enssence@gmail.com (hereinafter, “company”).

The company may, from time to time and as deemed appropriate, amend these Terms by publishing the revised and updated version on the website.

By accessing the website, users agree to fully comply with these Terms. Using and browsing our site, registering as a user, filling out our forms, and/or providing data directly or indirectly imply knowledge and acceptance of these Terms and the Privacy Policy, including express acceptance of the processing of personal data.

USER REGISTRATION

To register on the website, you must use the "Log In" option and provide the requested information. The registration process is simple and intuitive, and we only collect necessary details to identify, contact, and/or provide personalized service.

Once you submit the registration details, you will receive a confirmation email allowing you to complete the registration process.

Users are responsible for keeping their account access details (username and password) confidential and should not share them with third parties.

“MY ACCOUNT”

Through the “My Account” option, you can view or modify your personal details, edit your contact list and addresses, view your orders, and/or change your password.

In the event of misuse of the website, the company reserves the right to cancel the user’s registration and any ongoing orders.

The company ensures the confidentiality of all data provided by users. Data collection and processing are done securely to prevent loss or manipulation.

PRODUCT FEATURES

Product images on the website are for illustrative purposes only and do not form part of any contractual obligation by the company.

Regarding descriptions, specifications, and other details about products from our partners and/or suppliers, the company disclaims any responsibility for the validity and integrity of this content.

Since the data entered on the website is based on information provided by our suppliers, we strive to avoid typographical and calculation errors.

Should errors be identified, we will promptly correct them as necessary. The company reserves the right to cancel the customer’s order and refund the amount paid.

If incorrect information is identified on the website and an order is placed for such products, the customer will be informed and will have the right to cancel their purchase.

PRICES

Prices listed on the website are exclusive and in Euros, including taxes. Shipping fees are the customer’s responsibility and are charged at the end of the order, depending on selected products and the final amount. Additional charges for transportation, delivery, postal fees, and/or other costs may apply.

The company reserves the right to change prices at any time, but will always apply the price indicated on the website at the time the customer places the order (except in cases of website errors, where the company may cancel the order and refund the amount paid, without any additional costs to the company).

The company also reserves the right to modify information and commercial offers on the website, including products, promotions, commercial conditions, and services.

AVAILABILITY

The company commits to adhering to delivery times provided stock availability. If an ordered product is not in stock, the company will contact the customer by email or phone within an estimated 48 hours from the order date to inform them of the new delivery date or request a replacement with a similar product.

Except in cases of force majeure, the company commits to shipping the order within a maximum of 30 days from the day after the order is placed.

Due to technical and/or circumstantial issues, there may be discrepancies between quantities available for sale on the website and actual stock.

All promotional campaigns have limited stock and are exclusively available for online sales.

Currently, the website only accepts orders for delivery within the European Union.

RETURNS

The online return period is set at 5 (five) days from the date of product delivery. Note that products must be new and complete as received, and returned in their original condition. The return form is available on our website and should be completed and sent to contact.enssence@gmail.com or sent by registered mail with acknowledgment of receipt to the company's headquarters.

Please note that returns are only accepted for products in their original and complete state (original labels, packaging, accessories, manuals) and in perfect condition. Products returned incomplete, damaged, or used will not be accepted. Products should be sent in the original packaging, within a shipping box. Upon receipt of the product at our facilities, the company will assess the situation accordingly. Personalized products are made exclusively for you and cannot be exchanged/returned, except in case of manufacturing defects.

Additionally, if you wish to cancel the purchase (resolve the contract) after the product has been delivered, you have 5 (five) calendar days to notify the company of the cancellation, without needing to provide a reason. The period starts from the date the product was delivered. You may exercise your right of withdrawal by sending the appropriate form to contact.enssence@gmail.com, with the company committing to acknowledge receipt of your email, or by sending a registered letter with acknowledgment of receipt to the company’s headquarters. You have 5 (five) days from the date of notifying your decision to terminate the contract to return or deliver the item to the company (at the company’s headquarters), and you will be responsible for the return costs (including postal costs, if that is your delivery option). To return the order, you should complete the return form, print it, attach it to the order, and send it to the company’s headquarters. Shipping costs for the product(s) are the responsibility of the customer.

In case of exercising the right of withdrawal and timely return of the product, the company will make every effort to refund the amounts paid within 5 (five) days. The refund will be made using the same method of payment. Shipping costs, if applicable, will not be refunded as they are expenses outside the scope of the contracted service.

Note that you cannot cancel the purchase for:

  • Goods made to your specifications or personalized, or that, by their nature, cannot be re-shipped or may deteriorate or perish quickly;
  • Sealed goods not suitable for return for health or hygiene reasons, once opened after delivery;
  • Goods that, after delivery, are inseparably mixed with other items due to their nature.

Any package received without sender identification or sent COD will not be accepted.

WARRANTIES AND AFTER-SALES SERVICE

All new products sold benefit from a 2 (two) year legal warranty. The company commits to liaising with suppliers to carry out necessary repairs. For any issues with your product, you must send the merchandise with a copy of the invoice, the warranty certificate, and the return form.

Please note that the warranty cannot be claimed for problems resulting from misuse or non-compliance with the manufacturer’s usage specifications. We recommend that you read the user manual provided with the products (where applicable).

The company cannot be held responsible for not performing repairs/correcting defects if the manufacturer refuses to apply/activate the warranty.

Unaccepted repair estimates may be subject to administrative fees. If you agree with the estimate, you must make a bank transfer for the corresponding repair amount.

DISPUTES AND RESPONSIBILITIES

Portuguese law applies to all matters regulated by these Terms.

In case of disputes regarding the interpretation or application of these Terms and the contracts concluded through the website, the competent forum is the Judicial Court of the District of Leiria – Alcobaça, with express waiver of any other, without prejudice to mandatory laws.

The company is not responsible for delays and/or non-fulfillment due to force majeure, including public disturbances, total or partial strikes, events causing lack of or poor functioning (including delays) of postal services, transportation, or communication means, flooding, fire, tornado, hurricane, volcanic eruption, war, pandemic.

The company is not responsible for any indirect damages, including loss of business, loss of profit, loss of opportunity, damages, or fees resulting from the purchase of any product presented on the website, nor is it responsible for any lost profits or consequential damages related to any purchase made on the website and, for any reason, cannot be delivered as ordered.

The website is exclusively aimed at end consumers and not professionals.
